To start, let’s consider a basic question: What is foreclosure? Put simply, a home is considered subject to foreclosure once the homeowner defaults on, or misses, their fourth consecutive mortgage payment. Shortly thereafter, a notice is issued to the homeowner and they are allowed a reinstatement period to attempt to recover their mortgage status. However, if the homeowner cannot recover, the property will be considered foreclosed and will be sold at auction.

To sell your foreclosed property prior to auction, start by obtaining permission from your lender to make a short sale, or a sale in which the home will sell for less than the amount due on the mortgage. If you can present a reasonable explanation for why you have fallen behind in your payments and provide evidence of your willingness to take responsibility, getting such permission may not be an issue. Plus, lenders don’t want to have to deal with the lengthy financial and legal processes involved in foreclosure, so they may be more willing to negotiate than you’d think.

From there, you and your lender should establish an expected timeframe in which you’re allowed to sell the property. Once permission is obtained, your next step, of course, will be to find a real estate agent and navigate the market until your property is sold within the agreed upon timeframe.
